You don't really give enough Information. But from the wording in your question, if he was married a 2nd time, as your question seems to indicate, if he died without a legal will, his current wife will most likely get it all. Sorry, but that would be the case in most states. If he was not married at his death, then the children will inherit-share and share alike.
